Two men were shot early Wednesday morning at a west Montgomery nightclub, police say. One of the victim’s suffered life-threatening injuries and second suffered non-life threatening injuries, Lt. Denise Barnes said. Both are being treated at unspecified Montgomery hospitals. Police responded to Club Big Boyz at around 3:45 a.m. to the report of a person shot. No arrests have been made. Police haven’t released the circumstances surrounding the shooting and whether the shooting occurred inside or outside the club.
Legal Analysis: Commercial establishments can be held responsible for incidents which occur on their property. Some of the most common incidents involve shootings, assaults and sexual assaults.
Night clubs and other establishments have a responsibility to protect patrons. If the establishment was negligent with known dangers and security, their liability increases and they may be forced to pay victims for the injuries sustained.
